TERMS OF USE
Introduction
This Terms of Use Agreement ("Agreement") governs the use of the services ("Services") provided by Cohen & Cohen Productions, LLC, doing business as Sunday Screens ("Sunday Screens," "us," "we," or "our"). By accessing and using our Services, you ("you" or the "User") agree to be bound by this Agreement.
Services
Sunday Screens offers a subscription service that provides churches with licenses to download and use looping video assets in their services, online streams, content, etc.
Subscription and Payments
Subscriptions to our Services are available on a monthly or yearly basis, with the latter offered at a discounted rate. The User is responsible for all charges associated with their subscription and must cancel their subscription before renewal to prevent further charges. Due to the nature of digital files, no refunds will be given under any circumstances.
Intellectual Property
All videos and content on our website, with the exception of certain user-submitted images such as user reviews or photos from events where an end-user has used the files, are the property of Sunday Screens and are protected by copyright law. You may not copy, distribute, or reproduce any content from our website without our express written consent.
License Grant
Upon subscribing to our Services, Sunday Screens grants the User a non-exclusive, non-transferable, revocable license to use our video assets for their church services, online streams, and other related uses. The User may not resell, gift, or package the video assets, or any part of them (including still images derived from the videos), as stock assets in any format. The ownership of the video assets will remain with Cohen & Cohen Productions, LLC.
Restrictions on Use
The User's subscription only covers a license for one physical location. If the User's organization has multiple locations or sites, they should contact support@sundayscreens.com for information about discounted enterprise or multi-site bundles.
Limitation of Liability
We make no representations or warranties of any kind, express or implied, as to the operation of our website or the information, content, materials, or products included on our website. To the full extent permissible by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. We will not be liable for any damages of any kind arising from the use of our website or our subscription service, including but not limited to direct, indirect, incidental, punitive, and consequential damages.
Termination
If the User cancels their subscription, any video assets they have downloaded may still be used in projects that were released prior to the cancellation. However, the User is prohibited from using these video assets in new projects after the cancellation. Upon cancellation, the User is expected to delete all downloaded video assets from their media server and cease all use.
Sharing and Misuse
The User may not share the video assets outside of their subscribing organization. If Sunday Screens finds that the User has violated this term, we reserve the right to cancel the User's subscription and prohibit future use of our Services.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the state of Tennessee. Any dispute arising under or related to this Agreement shall be resolved exclusively through binding arbitration in accordance with the rules of the American Arbitration Association.
Changes to This Agreement
We reserve the right to modify this Agreement at any time. Any changes will be posted on our website and, where appropriate, notified to you by email.
